These Terms of Use ("Terms") govern access to and use of vistacare.ca (the "Website"), operated by VistaCare Services Ltd. ("VistaCare", "we", "us", or "our"). By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.

1. Website purpose

The Website provides general information about VistaCare's painting, exterior cleaning, interior cleaning, and related property care services. It also allows visitors to send quote and booking requests. Website content is for general information and convenience and may not describe every service condition, limitation, or price.

2. Eligibility and authority

You may use the Website only if you can form a binding agreement under applicable law. If you use the Website for a company, property owner, strata, landlord, tenant, or another person, you represent that you have authority to act for that party and to provide the information submitted.

3. Quote requests, booking requests, and service agreements

• Requests are not confirmations. Submitting a form does not guarantee availability, reserve a date or time, or create an obligation for VistaCare to accept the work.
• Dates and times are preferences. Any requested schedule remains subject to VistaCare's written or verbal confirmation.
• Estimates may change. A preliminary estimate may depend on the accuracy and completeness of information supplied and may be revised after inspection, measurement, access review, scope changes, material selection, hidden conditions, or other relevant circumstances.
• Taxes and additional work. Applicable taxes and approved additions or changes may be charged unless expressly included in a confirmed written price.
• Separate service terms control. An accepted estimate, work order, invoice, service agreement, or other written confirmation may contain additional terms for scope, payment, deposits, access, cancellations, warranties, safety, and completion. If those terms conflict with these Website Terms regarding the actual services, the service-specific terms control.

4. Your information and responsibilities

You agree to provide accurate, current, and complete information and to update VistaCare if relevant details change. You are responsible for ensuring that you are authorized to request work at the property and for disclosing information reasonably relevant to safe access and performance, such as known hazards, restricted areas, fragile surfaces, pets, occupants, parking restrictions, or building rules.

Do not submit credit-card numbers, bank account details, government identification numbers, medical information, alarm codes, or other highly sensitive information through Website forms or open-text fields.

5. Communications

When you submit contact information, you authorize VistaCare to contact you by telephone, email, or text message as reasonably necessary to respond to your inquiry, prepare or discuss a quote, confirm or change an appointment, perform or follow up on services, address an invoice, or provide customer support.

Promotional electronic messages will be sent only where VistaCare has the consent or other legal authority required by applicable law. You may withdraw marketing consent using the unsubscribe method provided or by contacting us. Transactional and service-related communications may continue where necessary.

6. Acceptable use

You must not:

• use the Website for an unlawful, fraudulent, misleading, threatening, abusive, or harmful purpose;
• impersonate another person or submit information without authorization;
• attempt to gain unauthorized access to the Website, server, accounts, code, or data;
• introduce malware, automated attacks, excessive traffic, or any technology intended to disrupt or damage the Website;
• scrape, copy, frame, mirror, or systematically extract Website content except as permitted by law or with written permission; or

No other right or licence is granted. "VistaCare" and associated branding may not be used without prior written permission.

8. Third-party links and services

The Website may contain links to third-party websites or rely on third-party infrastructure and communications services. Links are provided for convenience and do not imply endorsement. VistaCare does not control and is not responsible for third-party content, availability, terms, privacy practices, or security.

9. Website availability and disclaimers

To the maximum extent permitted by law, the Website is provided on an "as is" and "as available" basis. VistaCare does not promise that the Website will always be available, uninterrupted, error-free, secure, or free from harmful components, or that all Website information will always be complete, current, or suitable for a particular purpose.

Images, descriptions, service areas, timelines, and examples are illustrative and may change. You should rely on the final written quote or service agreement for the scope, price, schedule, and terms of a specific job.

Nothing in these Terms excludes or limits a warranty, condition, remedy, consumer right, or liability that cannot lawfully be excluded or limited. Any warranties relating to actual services are governed by the applicable service agreement and mandatory law, not by this Website disclaimer.

10. Limitation of liability for Website use

To the maximum extent permitted by law, VistaCare and its directors, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising from or connected with use of, or inability to use, the Website, including loss of data, opportunity, revenue, or profits.

This section applies to the Website and online request process. It does not replace liability terms in an accepted service agreement and does not limit liability that applicable law does not permit us to limit.

13. Governing law and disputes

Subject to any mandatory consumer protection or jurisdictional rights, disputes relating to these Terms or the Website will be submitted to the courts of British Columbia.

14. General

If any provision is found unlawful or unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement concerning use of the Website, but they do not replace an accepted service-specific agreement.
